Privacy Policy

Terra Virtualis respects your privacy and is fully committed to protecting your personal information and using it properly and in compliance with data privacy laws. Terra Virtualis recognizes the importance of protecting information collected from our users and has adopted this Privacy Policy to inform you about how data is gathered, used, processed, stored and disclosed, including your personal information in conjunction with access and use of our Services. By using the Services you agree that you have read the Terms of Service and understood this Privacy Policy, and all other terms and conditions of your use of the Products or Services. We will not share your personal information except as described herein.


Types of Information we collect:

User Input Information

Account information: Creating an account may require you to provide a username and password. Your username is public. You may also provide other account information like email address, biographical information, or images. We also store user account preferences and settings.

Content you submit: We collect the content you submit to the Services. This includes your images, text or any other type of content submitted thought designated applicable channels.

Actions you take: We collect information on actions you take while using the Services. This includes interactions with content, like upvoting, saving.

Transactional Information: If you purchase a Product or Services from Terra Virtualis, we will collect certain information from you including your name, address, email address, and information about the product or service which you are purchasing. Terra Virtualis uses industry standard payment processors (such as PayPal) to handle payment information.

Other information: You may choose to provide other information directly to us. We may collect feedback, activity on promotions, sponsored activities, job applications, customer support requests or other direct requests for contact.

Information collected automatically

Log and Usage Data: We may log information when you access and use  the Services. This may include IP addresses, under-agent string, browser-type, operating system, referral URLs, device information, device settings pages visited, links clicked, and the requested URL. Terra Virtualis will delete any IP address collected after 100 days.

Virtual Location and Gaze Tracking: We may receive and process your information about your virtual location but not your real-world location. We may use this information, for example to publish free and publicly available reports on public viewership and participation using anonymized data.


Information Collected from other sources

We may receive information about you from other sources, including from other users or third parties and combine that information with the other information we have. For example, we may receive demographic or interest information about you from partners, and use the combined data to create a clearer public report of the partner galleries success within their own student population. We do not collect or collaborate information for or with third parties such as advertisers or for-profit enterprises.

Information Collected from Integration: Terra Virtualis will not collect third party data about you using technologies such as emblems or advertising technologies.

Embedded Content: Terra Virtualis may display some linked content within Services via ‘embeds.’ For example, embedding a youtube link or live web link within the virtual environment. Terra Virtualis does not control how third-party services collect data when they service you their content direct via these embeds. As a result, embedded content is not covered by this privacy policy but by the policies of the service from which the content is embedded.

How we use your information

Provide, maintain, and improve the Services;

Research and Develop new exhibits and shows;

Send technical updates, notes, alerts, and other administrative messages;

Provide Customer Service;

Analyze and publicly report on trends within the virtual art environment;

Measure the effectiveness of works, building, and curation;

Personalize the Services, and provide optimized content and features that match user interests.

Terra Virtualis does not sell any of your information. We only share nonpublic information about you in the following ways:

With your consent: Users or partners that choose to display logos, names, biographical information, and images in relation to their work will be publicly viewable at your consent and at your discretion.

With service providers: We may share information with vendors, consultants, and other service providers who need access to such information to carry out work for us. Their use of personal data will be subject to appropriate confidentiality and security measures. A few examples: (i) payment processors who process transactions on our behalf, (ii) cloud providers who host our data and our services, (iii) partnering University or School looking for student engagement reports.

To comply with the law: We may share information in response to a request for information if we believe disclosure is in accordance with, or required by, any applicable law, regulation, legal process, or governmental request, including, but not limited to, meeting national security or law enforcement requirements. To the extent the law allows it, we will attempt to provide you with prior notice before disclosing your information in response to such a request.

In an emergency: We may share information if we believe it's necessary to prevent imminent and serious bodily harm to a person.

Aggregated or de-identified information: We may share information about you that has been aggregated or anonymized such that it cannot reasonably be used to identify you. For example, we may show the total number of viewers to a particular gallery or that looked at a particular work without revealing any identifying information such as usernames.


How we Protect your Information

You have choices about how to protect and limit the collection, use, and sharing of information about you when you use the Services.

We take measures to help protect information about you from loss, theft, misuse and unauthorized access, disclosure, alteration, and destruction. For example, we use HTTPS while information is being transmitted. We also enforce technical and administrative access controls to limit which of our employees have access to nonpublic personal information. We will never ask for your password by email (but may send you a temporary password via email if you have requested a password reset).

We store the information we collect for as long as it is necessary for the purpose(s) for which we originally collected it. We may retain certain information for legitimate business purposes or as required by law.

Changing your account information: You can access and change contain information through the Services.

Please note that permanently deleting your Account erases all of your information from our databases. After completing this process, you can no longer use any of your Services. Your Account and all its data will be removed permanently, and we will not be able to restore your account or retrieve your data in the future. If you contact Terra Virtualis Support in the future, the system will not recognize your Account and support agents will not be able to locate the deleted account.

Do Not Track Signals: We are strongly committed to not sharing nonpublic information and Personal Information with third parties. In particular, we do not allow tracking by third-party websites you have not visited (including analytics services, advertising networks, and social platforms), nor do we share your Personal Information with any third parties for marketing purposes. Because we protect all users in this manner, we do not change our behavior in response to a web browser's "do not track" signal.


Your Rights

Terra Virtualis is a nonprofit organization based in Norwalk, Iowa, with servers and data centers located in the U.S. If you decide to use the Services, within or outside the U.S., you understand that your information will be collected, transferred, stored, processed, discosloed, and otherwise used in the U.S. as described in this privacy policy. You also understand that your information can be transferred through other counties, which may have different or less stringent data protection laws than the United States or your country, in connection with providing Services to you.


EEA Users

These rights can be exercised using the information provided under “Your Choices” above or as described in the “Your Rights - Data Subject and Consumer Information Requests section” above. EEA users also have the right to lodge a complaint with their local supervisory authority.

As required by applicable law, we collect and process information about individuals in the EEA only where we have a legal basis for doing so. Our legal bases depend on the Services you use and how you use them. We process your information on the following legal bases:

You have consented for us to do so for a specific purpose;

We need to process the information to provide you the Services, including to operate the Services, provide customer support and personalized features and to protect the safety and security of the Services;

It satisfies a legitimate interest (which is not overridden by your data protection interests), such as preventing fraud, ensuring network and information security, enforcing our rules and policies, protecting our legal rights and interests, research and development, personalizing the Services, and marketing and promoting the Services; or
We need to process your information to comply with our legal obligations.


California Users

In the last 12 months, we collected the following categories of personal information from California residents, depending on the Services used:

Commercial information, including information about transactions you undertake with us.

Identifying information, like usernames, email addresses, IP addresses, and cookie information.

Internet or other electronic network activity information, such as information about your activity on our Services.

Audiovisual information in pictures, audio, or video content submitted to Terra Virtualis

Professional or employment-related information or demographic information, but only if you explicitly provide it to us, such as by applying for a job or filling out a survey.

If you are a California resident, you have additional rights under the CCPA, including the right to request access to or deletion of your personal information, and information about our data practices, as well as the right not to be discriminated against for exercising your privacy rights. These rights can be exercised as described in the Data Subject and Consumer Information Requests section above.


Children under the age of 13 are not allowed to create an account or otherwise use the Services. Additionally, if you are in the EEA, you must be over the age required by the laws of your country to create an account or otherwise use the Services, or we need to have obtained verifiable consent from your parent or legal guardian.

Changes to this Privacy Policy

From time to time, we may change this Privacy Policy to accommodate new technologies, industry practices, regulatory requirements or for other purposes. We will provide notice to you through our Services if these changes are material and, where required by applicable law, we will obtain your consent.  If you object to any changes, you may close your account. You acknowledge that your continued use of our Service after we publish or send a notice about our changes to this Privacy Policy means that the collection, use and sharing of your personal data is subject to the updated Privacy Policy.
